ServiceTasker Pty Ltd (“ServiceTasker”) is a platform designed to help homeowners and consumers discover, connect with, review, and hire a wide range of local service professionals and trade experts (collectively, “Professionals” or “Service Providers”) in the USA. These Terms of Use describe your responsibilities and rights when accessing or using the ServiceTasker website and related services.

1. ACCEPTANCE OF TERMS

The ServiceTasker website available at servicetasker.us, and all related platforms, features, tools, and services offered in connection with them (collectively referred to as the “Sites and Services”) are owned and operated by ServiceTasker Pty Ltd (“ServiceTasker”). Access to and use of the Sites and Services are subject to the following Terms of Use (“Terms”).

Please read these Terms of Use carefully. By accessing, downloading, registering with, or using any part of the Sites and Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not accept all of these Terms, you may not access or use the Sites and Services.

2. MODIFICATIONS TO TERMS OF USE

ServiceTasker reserves the right to update, modify, or change these Terms of Use at any time, at its sole discretion, and such changes will become effective upon being posted on the Sites and Services, with or without additional notice to you.

You are responsible for reviewing the Terms regularly to stay informed of any updates. Continued use of the Sites and Services after any changes have been posted indicates your acceptance of the revised Terms. If you do not agree to any amended terms, you must immediately discontinue use of the Sites and Services and may request to be removed from any communication or distribution lists associated with your account.

3. USE OF THE SITE AND SERVICES

Subject to your full compliance with these Terms of Use, ServiceTasker grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Sites and Services strictly for your personal, non-commercial use.

You agree not to access, reproduce, duplicate, copy, sell, resell, modify, distribute, transmit, or otherwise exploit any part of the Sites or Services, including any content, for any purpose other than personal use as expressly permitted by these Terms, without the prior written consent of ServiceTasker.

ServiceTasker reserves the right, at any time and without prior notice, to modify, update, suspend, or discontinue any part or all of the Sites and Services, temporarily or permanently, at its sole discretion. ServiceTasker shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

4. USER CONDUCT

As a condition of accessing and using the ServiceTasker Sites and Services, including submitting or interacting with any ratings, reviews, communications, information, text, images, audio clips, videos, data, or other materials (collectively, “Content”), you agree to use the Sites and Services only for lawful purposes and by these Terms of Use.

You further agree not to use the Sites and Services in any way that is prohibited by law, by these Terms, or that is not reasonably intended by ServiceTasker.

You agree that you will not:

  • Violate these Terms of Use or any applicable local, state, national, or international law or regulation;
  • Infringe upon or violate the rights of any third party, including intellectual property rights, privacy, publicity, contractual, or fiduciary rights;
  • Use the Sites and Services to distribute unsolicited commercial content, promotional materials, or other forms of solicitation, including spam, junk mail, or pyramid schemes;
  • Reproduce, duplicate, copy, sell, resell, exploit, or misuse any part of the Sites, Services, or Content for any commercial, political, educational, religious, or non-personal purpose without prior written permission from ServiceTasker;
  • Post irrelevant, repetitive, or inappropriate Content, or engage in any activity that places an unreasonable load on the infrastructure or interferes with the normal operation of the Sites and Services;
  • Harass, intimidate, impersonate, or misrepresent your identity or affiliation with any person or entity, including misrepresenting your association with ServiceTasker;
  • Submit false, misleading, or deceptive information or reviews;
  • Use the Sites and Services if you are under the age of eighteen (18);
  • Attempt to manipulate or undermine the review and rating systems provided on the Sites and Services;
  • Attempt to gain unauthorised access to any part of the Sites and Services, user accounts, systems, or networks connected to ServiceTasker;
  • Share, sell, or transfer your account credentials or any rights granted under these Terms;
  • Upload or transmit any content or files that contain viruses, malware, corrupted data, or any software or programs designed to interrupt, damage, or limit the functionality of any part of the Sites and Services;
  • Use automated tools or technologies such as bots, crawlers, scrapers, or spiders to access, monitor, or extract data from the Sites and Services;
  • Attempt to bypass, test, breach, or compromise the security, encryption, or authentication measures of the Sites and Services or related systems;
  • Attempt to trace or collect personal data of other users without their express permission, or engage in any activity that seeks to uncover personal, private, or identifying information of other users, except as explicitly permitted by ServiceTasker.

ServiceTasker reserves the right to investigate and take appropriate legal action against anyone who, in ServiceTasker's sole discretion, violates any part of this User Conduct policy.

5. SERVICETASKER’S SERVICES

When accessing, using, or purchasing specific services, tools, or features offered through the Sites and Services, you may be subject to additional posted terms, guidelines, or rules specific to those services or features. These additional terms are hereby incorporated by reference into these Terms of Use. In the event of any conflict between these Terms and the terms applicable to a specific service or feature, the specific terms shall govern your use of that service or feature.

6. REGISTRATION INFORMATION

To access or use certain areas of the Sites and Services, or to utilize particular features or tools, you may be required to create a user account. As part of the registration process, you may be prompted to provide a username, password, and other relevant information.

As a condition of using the Sites and Services, you agree to:

  • Provide true, accurate, current, and complete information as requested through ServiceTasker’s registration forms; and
  • Maintain and promptly update this information to ensure it remains accurate and complete.

You are solely responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. ServiceTasker is not liable for any loss or damage arising from your failure to protect your account details.

While there may be valid reasons for having more than one account (e.g., separate accounts for personal and business use), creating multiple overlapping or fraudulent accounts may result in suspension or termination. If you have questions about account management or multiple account use, please contact ServiceTasker support directly.

7. SUBMITTING CONTENT

By submitting any content, including but not limited to reviews, ratings, feedback, comments, photos, videos, or other materials (collectively, “Content”) to the ServiceTasker Sites or Services, you agree to the following:

  • You grant to ServiceTasker a royalty-free, perpetual, irrevocable, worldwide, non-exclusive, transferable, and sublicensable license to use, reproduce, adapt, modify, publish, merge, translate, distribute, publicly display, create derivative works from, and incorporate your Content into other works, in any media or platform now known or later developed.
  • You grant ServiceTasker all necessary rights to publish (or not publish) your name in connection with your Content and to sublicense your Content to third parties through multiple levels of distribution.
  • You acknowledge that once submitted, this license cannot be revoked and that ServiceTasker may, but is not obligated to, use your Content.
  • You grant ServiceTasker the rights to prevent the copying, reproduction, aggregation, republication, scraping, or other unauthorized use of your Content by third parties.
  • Your submitted name and review details may be made publicly available, including to the service providers you have reviewed.
  • You represent and warrant that you either own or have secured all necessary legal rights to the Content you submit, and that it does not infringe the intellectual property, privacy, or publicity rights of any third party.
  • If any person is identifiable in your Content (e.g., in a photo or video), you warrant that you have received their consent (or their parent’s/guardian’s consent if a minor) for the Content to be used as described herein.
  • You are solely responsible for the accuracy, legality, and truthfulness of your submitted reviews and ratings.
  • ServiceTasker reserves the right, at its sole discretion, to remove or retain any Content, including reviews and ratings, at any time and for any reason.

You also agree that you will NOT submit any Content that:

  • Is false, misleading, defamatory, obscene, harassing, abusive, hateful, offensive, threatening, vulgar, unlawful, or otherwise objectionable;
  • Is based on anything other than your own personal, first-hand experience with the service provider (or, in certain cases, on the first-hand experience of someone you are legally authorized to speak on behalf of);
  • Contains any hyperlinks, advertisements, or solicitations;
  • Comments on or attacks other users or their content;
  • Is submitted by someone who has a conflict of interest (e.g., you work for, own, or are related to the service provider);
  • Has been submitted in exchange for payment, incentive, or other compensation;
  • Lacks sufficient detail to be meaningful (e.g., "They’re great!" without context);
  • Does not reflect your honest opinion or full disclosure of your experience.

All submitted reviews and ratings reflect the views of the user, not of ServiceTasker, its owners, directors, employees, or affiliates.

8. PUBLICATION AND DISTRIBUTION OF CONTENT

ServiceTasker does not guarantee the accuracy, integrity, quality, or appropriateness of any Content submitted to or displayed through the Sites and Services. You acknowledge and agree that ServiceTasker acts only as a passive conduit and interactive platform for the publication and distribution of Content, including any responses or materials posted by Service Providers (collectively, “Service Provider Content”).

All Content and Service Provider Content available on or transmitted through the Sites and Services are the sole responsibility of the person or entity from whom such Content originated. ServiceTasker does not control, endorse, or guarantee the accuracy, reliability, or legality of any Content or Service Provider Content, and by using the Sites and Services, you may be exposed to content that is inaccurate, misleading, offensive, or otherwise objectionable.

It is your sole responsibility to evaluate and bear all risks associated with your use of any Content or Service Provider Content. ServiceTasker has no obligation to monitor, screen, or approve any Content or Service Provider Content but reserves the right, in its sole discretion, to remove any Content that violates these Terms or is otherwise objectionable.

By using the Sites and Services, you agree that ServiceTasker will not be liable for any loss or damage arising from the use or reliance on any Content or Service Provider Content, including but not limited to errors, omissions, defamatory statements, or the disclosure of confidential or private information.

If you believe any Content violates these Terms or is unlawful, you may report it through our Member Support channels. Please note that false or unlawful claims may subject you to liability, including costs and attorneys’ fees.

ServiceTasker may establish and modify general practices, policies, and limits related to the use of the Sites and Services (e.g., limits on the number, length, or retention of reviews and ratings, or access frequency). ServiceTasker is not responsible for any deletion or failure to store Content or other materials.

9. SERVICE PROVIDERS

ServiceTasker does not endorse, guarantee, or assume responsibility for any Content, data, advertising, products, goods, or services provided by third parties or Service Providers, including but not limited to contractors, trade professionals, or health and wellness providers.

Your use or reliance on any such third-party offerings is at your own risk. Any dealings, agreements, promotions, warranties, or disputes are strictly between you and the Service Provider and do not involve ServiceTasker.

Third-party or Service Provider websites may be linked to or referred to through the Sites and Services. ServiceTasker does not control or operate these external sites, and any information you provide on those sites is subject to their privacy policies and terms. ServiceTasker is not responsible for the content, security, availability, or your interactions on those third-party sites.

You waive and release ServiceTasker from any claims or liabilities related to your interactions or transactions with Service Providers or third parties discovered via the Sites and Services.

10. HEALTH-RELATED PROVIDERS

The ServiceTasker Sites and Services, and the Content provided therein, are for informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional with any medical questions or concerns you may have. Never disregard or delay seeking medical advice based on information found on the Sites and Services.

In case of a medical emergency, please call your physician or emergency services immediately.

ServiceTasker does not recommend, endorse, or guarantee any specific medical tests, treatments, physicians, products, procedures, opinions, or other health-related information that may appear on the Sites and Services. ServiceTasker is not a healthcare or wellness provider and does not refer or recommend any specific health professionals.

Health-related content on the Sites may include materials that are explicit or sensitive. If you find such materials offensive, you should not use the Sites and Services.

If you post health-related information about yourself or others, you do so at your own risk. When posting health information about someone else, you represent that you have the legal authority to disclose that information and that sharing such information complies with all applicable privacy laws. You acknowledge that any health information you post becomes public and may violate privacy protections. Additionally, Service Providers may post content containing your private health information in response to your submissions, for which ServiceTasker assumes no liability. ServiceTasker cannot guarantee confidentiality for health information shared on or through the Sites and Services.

11. TERMINATION

ServiceTasker may terminate or suspend your access to the Sites and Services at any time, without prior notice, for any reason. Upon termination, you must immediately stop using and accessing the Sites and Services.

ServiceTasker reserves the right to take any technical, legal, or other actions to block, restrict, or prevent your access. This right is in addition to any other remedies ServiceTasker may have.

Provisions of these Terms that by their nature should survive termination, including but not limited to ownership rights, disclaimers, indemnity, and limitations of liability, shall continue to apply after termination.

13. TRADEMARKS AND COPYRIGHTS

ServiceTasker, including its logos, designs, graphics, page headers, button icons, scripts, and service names, is a trademark owned by ServiceTasker Pty Ltd in the USA and/or other countries. These trademarks may not be used in connection with any product or service in any manner that could cause confusion or imply sponsorship or endorsement by ServiceTasker without prior written permission.

Except for user-submitted Content, all materials on the Sites and Services—including but not limited to text, graphics, logos, icons, images, audio and video clips, downloads, data compilations, and software—are the exclusive property of ServiceTasker and its licensors and are protected under American and international copyright laws.

14. NOTICES

You agree that ServiceTasker may send you notices under these Terms of Use via email, regular mail, or by posting notices on the Sites. Any notices you send to ServiceTasker must be sent by first-class certified mail to support@servicetasker.us.

Notices will be deemed received upon confirmation of delivery or two (2) business days after being sent, whichever occurs first.

By the Digital Millennium Copyright Act (DMCA), ServiceTasker has designated an agent to receive notifications of claimed copyright or trademark infringement. If you believe your copyrighted or trademarked work has been infringed, please submit a written notice containing the following to our Designated Agent:

  • A physical or electronic signature of the person authorized to act on behalf of the owner of the exclusive right claimed to be infringed;
  • Identification of the copyrighted or trademarked work you claim has been infringed, or a representative list if multiple works are involved;
  • Identification of the material alleged to be infringing and information sufficient to locate it on the Sites and Services;
  • Your contact information, including address, phone number, and email.
  • A statement that you have a good faith belief that the use is unauthorized by the owner, agent, or law; and
  • A statement that the information in your notice is accurate and that you are authorized to act on behalf of the owner, under penalty of perjury.

ServiceTasker will investigate and take appropriate action in response to valid notices. Notices that do not comply with these requirements may not receive a response.

15. DELAYS AND ACCESSIBILITY

The Sites and Services rely on the internet and electronic communications, which may be subject to delays, failures, outages, or other technical problems. ServiceTasker is not responsible for any damages, losses, or inconvenience resulting from these issues.

16. USER FEEDBACK

ServiceTasker values your feedback about our Sites and Services. However, we do not accept unsolicited creative ideas, suggestions, or materials beyond what we specifically request.

If you send us any creative submissions, including ideas, concepts, drawings, or other materials (“Submissions”), you grant ServiceTasker ownership of these Submissions without any obligation of confidentiality or compensation. ServiceTasker may use, disclose, or modify these Submissions in any way without restriction or liability.

17. WARRANTIES AND DISCLAIMERS

You acknowledge and agree that ServiceTasker has no control over, and is not responsible for:

  • Which users access or use the Sites or Services?
  • How you interpret or use any content found on or through the Sites or Services;
  • What effect such content may have on you, or
  • What actions may you take as a result of being exposed to any such content?
  • By using our Sites or Services, you agree to release ServiceTasker from any liability related to your access to, use of, or inability to obtain content, services, or information through the platform. The Sites and Services may include or direct you to content that some users may find offensive, inaccurate, or otherwise objectionable. ServiceTasker makes no representations or warranties regarding the legality, accuracy, reliability, or appropriateness of any content accessible through our Sites or Services.

YOU USE THE SITES AND SERVICES ENTIRELY AT YOUR OWN RISK.

All Sites and Services are provided on an “as is” and “as available” basis, without any warranties of any kind, express or implied. ServiceTasker disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Neither ServiceTasker nor its affiliates, agents, employees, directors, or content providers shall be liable for any direct, indirect, incidental, special, consequential, compensatory, or punitive damages (including, without limitation, loss of profits or data) arising from:

  • Use or inability to use the Sites or Services;
  • Any errors or omissions in the content.
  • Delays, failures, or disruptions in internet service or communications;
  • Malware, viruses, or other harmful components;
  • Unauthorized access to user information or data;
  • The actions or inactions of any third party.
  • This includes damages resulting from negligence, cyberattacks, or third-party misconduct.

ANY MATERIAL YOU ACCESS, DOWNLOAD, OR OTHERWISE OBTAIN THROUGH THE SERVICE IS DONE AT YOUR OWN RISK, and you alone are responsible for any resulting damage to your computer system or data loss. ServiceTasker makes no warranty that:

  • The Sites or Services will meet your specific requirements.
  • The Sites or Services will be uninterrupted, secure, or error-free
  • The information, results, or content obtained will be accurate or reliable.
  • Any errors in the platform or its software will be corrected.
  • Any products or services obtained via the platform will meet your expectations.

From time to time, we may temporarily remove or suspend access to the Services without notice.

Some jurisdictions do not allow exclusions or limitations on implied warranties or liability for certain damages. If that applies to you, some of the above limitations may not apply, but our liability will still be limited to the fullest extent permitted by applicable law.

ServiceTasker does not endorse, control, or take responsibility for the availability, content, advertising, products, or services found on or through such external sites. You agree that we are not liable for any damage or loss caused—or alleged to be caused—by your use of or reliance on such third-party resources.

18. INDEMNITY

You agree to indemnify, defend, and hold harmless ServiceTasker, its affiliates, officers, employees, agents, licensors, partners, users, successors, assigns, and service providers from and against any losses, liabilities, claims, damages, demands, actions, costs, and expenses (including reasonable legal fees and court costs) arising out of or related to:

  • (a) Your violation of these Terms of Use;
  • (b) any inaccurate, false, or misleading information or content you submit, post, transmit, or otherwise provide through the Service; or
  • (c) any intentional, willful, or negligent act by you that violates the rights of another or causes harm to any party.

ServiceTasker reserves the exclusive right to assume the defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with ServiceTasker in asserting any available defenses.

19. LIMITATIONS OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT SERVICETASKER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR COMPENSATORY DAMAGES (EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), INCLUDING BUT NOT LIMITED TO DAMAGES FOR:

  • (A) LOSS OF PROFITS OR REVENUE;
  • (B) LOSS OR CORRUPTION OF DATA;
  • (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR INFORMATION;
  • (D) RELIANCE ON ANY CONTENT OR SERVICE MADE AVAILABLE THROUGH SERVICETASKER;
  • (E) INTERACTIONS, DEALINGS, OR DISPUTES WITH SERVICE PROVIDERS OR OTHER USERS;
  • (F) ANY OTHER CLAIM OR DISPUTE RELATED TO YOUR USE OF THE PLATFORM.

These limitations apply regardless of whether the claim is based on contract, tort, negligence, strict liability, or any other legal theory. Some jurisdictions may not allow certain limitations of liability, in which case ServiceTasker's liability shall be limited to the fullest extent permitted by law.

You acknowledge that ServiceTasker uses third-party vendors to process payments. You agree that these third parties (“Released Parties”) bear no responsibility for any failure of ServiceTasker to provide services under this Agreement. You hereby release and agree to hold harmless the Released Parties from any claims or losses related to such failures or breaches.

20. MISCELLANEOUS

If you violate any provision of these Terms of Use or any related agreement with ServiceTasker, we reserve the right to pursue all legal and equitable remedies available, including but not limited to direct, indirect, consequential, and punitive damages, as well as injunctive relief. Our rights and remedies are cumulative and may be exercised independently or in combination. Failure by ServiceTasker to enforce any part of these Terms at any given time does not constitute a waiver of our right to enforce the same or any other provision in the future.

If any part of these Terms of Use is determined to be invalid, illegal, or unenforceable, that provision shall be modified or limited to the extent necessary so that the remainder of the Terms remains in full force and effect.

You may not assign, transfer, or sublicense your rights or obligations under these Terms without prior written consent from ServiceTasker. We may assign or transfer our rights and obligations under these Terms at any time without notice or consent.

You are solely responsible for ensuring compliance with all applicable local, state, and federal laws and regulations related to your access and use of the Site and Services.

No agency, partnership, joint venture, or employment relationship is created between you and ServiceTasker by your use of the Site or Services.

You also agree and acknowledge that any Released Party (as defined in Section 19) is an intended third-party beneficiary of these Terms and may enforce the applicable provisions directly.

Final Agreement

These Terms of Use, along with our Privacy Policy and any additional agreements or guidelines referenced herein, constitute the complete agreement between you and ServiceTasker concerning your use of our platform. This agreement supersedes all prior or contemporaneous understandings, whether oral or written.

You acknowledge that other agreements may exist between you and third parties (such as Service Providers), and you represent that such agreements do not conflict with your obligations to ServiceTasker under these Terms.
